Is Your Text Marketing Already Compliant With NYC’s New “Click to Cancel” Rule?

STOP-to-opt-out has been baked into SMS marketing for years, which puts most compliant programs ahead of a law the rest of the subscription world is scrambling to catch up to. Here’s what the rule says, and where gaps in compliance can hide:


If you live in New York City, or you run a business that has customers there, you probably heard the news this week: Mayor Mamdani announced a first-in-the-nation “Click to Cancel” rule. Starting October 1, 2026, any business signing up NYC residents for a subscription (gym memberships, streaming, apps, etc.) has to make canceling just as easy as signing up. 

Businesses that don’t comply are looking at restitution for customers plus civil penalties starting at $525 per violation and climbing to $3,500 for repeat offenses. The city estimates this could save New Yorkers somewhere between $21.5 million and $162.5 million a year, plus a genuinely wild 600,000 hours of collective time nobody has to spend on hold with a “customer retention specialist” anymore.

This whole concept (sign up easily and leave easily) is not new to us. It’s been the law for text message marketing for a very long time in terms of SMS history.

SMS Marketing Already Runs on “Easy In, Easy Out”

Under TCPA rules and basically every carrier guideline that governs texting, opting into an SMS program has always come paired with an equally simple way out. Someone texts a keyword to join your list, and one text — STOP — takes them off it. 

The FCC and mobile carriers have never been shy about penalizing brands that make opting out difficult, bury it in fine print, or ignore STOP requests altogether. So while streaming services and gyms are only now catching up to “hey, maybe don’t trap people,” text marketing built that expectation into its DNA from day dot.

Which is a long way of saying: if you’re already texting your customers the right way, NYC’s new rule isn’t a headache for you. It’s a vibe check you already passed. Go you!

What This Means If You’re Building (or Fixing) Your Text Program

Transparency isn’t optional anymore. The rule requires businesses to clearly disclose subscription terms upfront. For SMS programs, that means your opt-in language needs to be crystal clear about what someone’s signing up for, how often they’ll hear from you, and how to leave. Vague opt-in copy that technically checks a legal box but reads like it was written to confuse people is exactly the kind of thing regulators are gunning for right now. Beware.

Cancellation has to match the sign-up method. If someone joined your list by text, they need to be able to leave by text. This one’s an easy yes for SMS, since STOP has always worked this way, but it’s worth double-checking that your actual opt-out flow is instant and doesn’t have any weird lag or manual steps on your end.

Your list health is about to matter even more. Businesses that make it hard to leave tend to end up with bloated, resentful lists full of people who’d rather block your number than engage with it. A clean opt-out process actually keeps your list full of people who want to be there, which is better for deliverability, engagement, and your own sanity when you’re reading the analytics.
